Terms and Conditions
By utilizing this website or placing an order with Kansas Arms Supply, LLC, you are acknowledging and accepting the following declarations and sales terms.
Customer Affidavit:
- I confirm that I am not presently below the age of eighteen (18) years.
- I understand that, by selling or delivering ammunition and/or firearms accessories to me, Kansas Arms Supply, LLC, is in compliance with all applicable state and local laws and regulations.
- I have never been indicted for or convicted of a crime punishable by imprisonment exceeding one year.
- I am not a fugitive from justice.
- I am not an unlawful user of, or addicted to, any controlled substance.
- I have never been adjudicated as mentally defective, nor have I been committed to a mental institution.
- I am not an illegal or unlawful alien, and I am not a non-immigrant alien.
- I have never been, nor am I expected to be, discharged from the Armed Forces under dishonorable conditions.
- I have not renounced my U.S. citizenship.
- I am not currently subject to any form of domestic violence restraining order.
- I have never been convicted, nor am I expected to be convicted, in any court of a misdemeanor crime of domestic violence.
- I commit to not engaging in unauthorized exports of any defense articles.
Agreement to Indemnify and Defend for Misrepresentation:
Should any of the statements outlined under the "Customer Affidavit" section of these Terms and Conditions prove to be untrue, you consent to releasing, indemnifying, and assuming responsibility for defending Kansas Arms Supply, LLC, its owners, agents, officers, and employees against any resultant damages. This includes covering reasonable attorney fees, civil liability, or criminal prosecution.
Shipping:
We make every effort to ensure the smooth and prompt delivery of your products to your designated address. During the checkout process, you will have the opportunity to select your preferred shipping method and provide your shipping address. Please note that once the checkout process is complete, you cannot change this information. Title to your products transfers to you upon their delivery to the address you specified at checkout, as documented in the shipping carrier's records. Following delivery, you assume full responsibility for the products, including the risk of theft or damage. You hereby release Kansas Arms Supply, LLC, from any liability or responsibility for your products once they have been delivered.
Shipping Destination Restrictions:
Kansas Arms Supply, LLC, will not ship to locations where it is prohibited by law. Any attempt to have products shipped to such restricted areas will result in the cancellation of your order, and you may incur a cancellation fee, as described below.
Order Cancellation by Customers:
To streamline the order processing and provide the best customer service, it is strongly recommended to ensure the accuracy and completeness of your order at the time of placement. After an order has been sent for processing, we may not be able to accommodate cancellations or changes.
Order Cancellation by Kansas Arms Supply, LLC:
While we prefer not to cancel orders, we reserve the right to do so if customers fail to adhere to these Terms and Conditions. In such cases, you will receive a full refund of your purchase amount.
Returns:
Products must be returned within 30 days from the shipment date. To initiate a return, please email us at Chris.Baxter@ksarmssupply.com, and one of our customer service representatives will provide you with a Return Authorization (RA) number. Ensure that the RA number is included with your return to facilitate the correct refund or exchange. Any damages must be duly noted. All returned products are examined upon arrival at our warehouse. After assessment, we will either send you a replacement or issue appropriate store credit. Only products in new and sell-able condition will qualify for a full credit, except when the damage occurred during transit and you properly reported and documented it. If you wish to have the product returned to you after it has reached our warehouse, additional payment will be collected from you to cover the shipping costs.
Release of Liability and Agreement to Indemnify and Defend:
While Kansas Arms Supply, LLC, strives to offer high-quality products and exceptional customer service, it acts solely as a retailer for products designed, manufactured, and tested by other companies. Therefore, you acknowledge that Kansas Arms Supply, LLC, is not liable for any claims, damages, or breaches of warranty, whether express or implied, related to the products listed on the website. Additionally, you understand and agree that Kansas Arms Supply, LLC, disclaims liability for the accuracy and use of information provided by the company. Manufacturers are the primary sources for information about their products, including essential safety information. Before purchasing and using products from Kansas Arms Supply, LLC, you must review all information and safety warnings from product manufacturers. By placing an order with Kansas Arms Supply, LLC, you accept sole responsibility for the product's use, whether by you or any other party. You agree to release, indemnify, and defend Kansas Arms Supply, LLC, and its owners, agents, officers, and employees against any resultant damages, including reasonable attorney fees, civil liability, or criminal prosecution stemming from or related to the products you purchase, including their use, storage, or transportation. If any other party files a claim against Kansas Arms Supply, LLC, arising from your purchase, use, storage, or transportation of products from the company, you will indemnify and cover Kansas Arms Supply, LLC, and its owners, agents, officers, and employees for any damages, including reasonable attorney fees, civil liability, or criminal prosecution.
Jurisdiction:
In the event that you initiate a lawsuit against Kansas Arms Supply, LLC, its owners, agents, officers, or employees, you agree that the lawsuit must be filed in a court located in Cowley County, Kansas. Any lawsuit filed in a different jurisdiction will be promptly transferred to Cowley County, Kansas, and you will be responsible for reimbursing Kansas Arms Supply, LLC, and its owners, agents, officers, and employees for any costs incurred in defending the lawsuit or facilitating its transfer to a court in Cowley County, Kansas.
Governing Law:
You consent to the application of Kansas law to govern (i) your purchase and use of products from Kansas Arms Supply, LLC; (ii) any information you receive from Kansas Arms Supply, LLC; (iii) any legal action initiated against you by Kansas Arms Supply, LLC; and (iv) any legal action you initiate or that is initiated by another party as a result of your actions against Kansas Arms Supply, LLC.
Class Action Waiver:
You agree that any dispute resolution proceedings, including litigation, arbitration, or mediation, between you and Kansas Arms Supply, LLC, will be conducted exclusively on an individual basis and not as part of a class, consolidated, or representative action. By making this agreement, you acknowledge that this is a knowing, voluntary, and permanent waiver of your right to bring any claims against Kansas Arms Supply, LLC, as part of a class or on behalf of any other individuals.

Kansas Arms Supply, LLC, retains customer names and email addresses to stay in touch and inform them of sales and specials. By creating an account or placing an order on the Kansas Arms Supply, LLC website, you authorize the company to send you follow-up emails about your purchase and emails providing information about other products or services.
